Witness reveals how Justice Chitembwe received Sh100m bribe

An
affidavit sworn by one, Amana Saidi Jirani (National Identity Card Number
6732455 and PIN No A011446450) implicates
High Court Judge Saidi
Juma Chitembwe in Sh100 million fraud.
In the
affidavit sworn before Edward Cheruiyot, Commissioner for Oaths, Jirani swears he was a nominee of Justice Chitembwe with regards to Title
Number: Kwale/Galu Kinondo/779 and the transaction regarding
the same parcel of land the upshot of Succession No. 97 of 2015 – In
the Matter of the Estate of Peter Warner (the "Deceased)
He says he
had full authority
to deal, negotiate and receive payment in Justice Chitembwe's name in this
regard.
Jirani
avers that he was aware
the said land was being purchased by proposed
purchasers for Sh305 million.
He says he
had been instructed by
Justice Chitembwe to handle the transaction as his nominee being
the registered owner of Title Number: Kwale/Galu Kinondo/779 as proxy/nominee.
Jirani
adds that Justice
Chitembwe had explained to him the
circumstances and consideration of his interest in the said property being Judgment
he delivered 0n
Succession No. 97 of 2015 in which he was to receive Sh100 million bribe.
He says Justice Chitembwe
introduced him to
former Nairobi Governor Mike Mbuvi Sonko and he
instructed Sonko to deal with him on issues pertaining to sale and
receipt of purchase price.
Jirani
says he had been
authorised to collect Sh100
million on behalf of Justice Chitembwe in the sale of the property.
He says Justice Chitembwe could not have put in his name due to conflict of interest having delivered the said judgment.
Jirani
adds that Justice
Chitembwe had confided to him he
did not want to deal with the matter
directly in view of the conflict relating to Constitutional Petition No. E425
of 2020 and Constitutional Petition No. E005 of 2021 in which the matters
relate to the impeachment of Sonko where he was
the Presiding Judge.
